          PATENT ROUNDTABLE: THE BATTLE OVER GENE PATENTING – DID
          JUDGE SWEET GET IT RIGHT?
          DECEMBER 2, 2009 @ 6 PM
          HOUSE OF THE ASSOCIATION, 42 WEST 44TH ST.
          In a recent controversial decision, Judge Sweet of the Southern
          District of New York refused to dismiss an action brought by the ACLU
          and the Public Patent Foundation on behalf of cancer researchers and
          women with breast cancer, or who may have the breast cancer gene,
          to invalidate patents relating to the gene. (Assoc. for Molecular
          Pathology et al. v. USPTO et al) Plaintiffs argue that genes should
          not be patentable subject matter under the patent laws, and that such
          patents are unconstitutional because they violate the right to free
          speech and impede the progress of science and the useful arts under
          Article I of the Constitution. The Court denied a motion to dismiss
          the complaint, finding that the plaintiffs have standing, and
          sufficiently stated causes of action for constitutional violations.
          Plaintiffs have now moved for summary judgment.
          At this interactive session, plaintiffs counsel from the Public
          Patent Foundation, a non profit organization which
          protects freedom in the patent system, and other patent prosecutors
          and litigators will discuss the various issues this case raises.
          Members of the Association and their guests are all welcome. The
          program is free.
